Terms & Conditions

This Agreement sets out the legally binding terms of your use of DESPERATE AND DATELESS and your membership in the Service and may be modified by DESPERATE AND DATELESS as needed, such modifications will be effective upon the date of posting to DESPERATE AND DATELESS.

1. Eligibility. You must be twenty one or over to register as a member of DESPERATE AND DATELESS. Membership is void where prohibited. By using the Website, you represent and warrant that you have the right and authority to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

2. Changes and Cancellations. Cancellations and changes can be made via email to paypal@mystore-online.com.

3. Standards. DESPERATE AND DATELESS will not accept an advertisements placed with the following:

• is offensive to the members of DESPERATE AND DATELESS, such as advertisements that promote racism, hatred or physical harm;
• harasses another person;
• involves the transmission of unsolicited mass mailing or "spamming";
• promotes information that you know is misleading or promotes illegal activities;
• promotes an illegal or unauthorized copy of another person’s copyrighted work;
• solicits personal information from anyone under 18;
• engages in commercial activities written consent of DESPERATE AND DATELESS.
  

4. Delivery, Frequency and Makegood. All figures relating to the number of advertisements served as determined by DESPERATE AND DATELESS shall govern, regardless of whether Member is using the services of a third party ad server. If DESPERATE AND DATELESS fails to provide the guaranteed number of impressions, DESPERATE AND DATELESS will make good on this contract.

5. Key Words and Phrases. DESPERATE AND DATELESS offers no exclusivity on keywords or phrases. Each advertiser will be given ranking positions based upon the bid they enter on keywords/phrases.

6. Rejections. DESPERATE AND DATELESS reserves the right, without liability, to reject, omit or exclude any person or to reject or terminate any memberships for any reason at any time, with or without notice to the member, and whether or not such membership was previously acknowledged, accepted, or published.

7. Licenses and Indemnification. Member grants DESPERATE AND DATELESS the right to use, reproduce, publicly display and distribute member's advertisements and collateral information and warrants that Member has the right to grant such license. Member represents that the advertiser is the owner or is licensed to use the entire contents and subject matter contained in its advertisements and collateral information, including, without limitation, (a) the names and/or pictures of persons; (b) any copyrighted material, trademarks, service marks, logos, and/or depictions of trademarked or service marked goods or services; and (c) any testimonials or endorsements contained in any advertisement submitted to DESPERATE AND DATELESS. In addition, Member represents that the member's advertisements and collateral information do not violate any applicable local, state or federal law or regulation. In consideration of DESPERATE AND DATELESS's acceptance of such advertisements and information for publication, the advertiser and agency will jointly and severally indemnify and hold harmless DESPERATE AND DATELESS and its officers, directors, shareholders, employees, accountants, attorneys, agents, parent, affiliates, subsidiaries, successors and assigns from and against any and all third party claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses, arising out of or related to: (i) Member's breach of any covenants, representations and warranties made therein, (ii) DESPERATE AND DATELESS's performance under this contract, and (iii) the copying, printing, distributing, transmitting or publishing of member's advertisements or collateral information by DESPERATE AND DATELESS.

8. Limitation of Liability. UNDER NO CIRCUMSTANCES WILL DESPERATE AND DATELESS BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, FOR LOST INCOME OR PROFITS, IN ANY WAY ARISING OUT OF OR RELATED TO THIS CONTRACT, EVEN IF DESPERATE AND DATELESS HAS BEEN ADVISED AS TO THE POSSIBILITY OF SUCH DAMAGES.

Except as provided in this Privacy Policy and the End-User Agreement, we do not share this information with outside parties without your permission except to the extent that is necessary to administer the services we offer our Clients and End-Users or to comply in responding to subpoenas, court orders or other legal proceedings.
 
From time to time, we also use the information you provide about yourself or others to inform you of additions or improvements to the DESPERATE AND DATELESS services.
